Terms of Use

These Terms govern your use of PingBlu. By creating an account, accessing, or using PingBlu, you agree to these Terms.

1. The Service

PingBlu provides location-based reminders, Saved Places, parking and place-memory features, sharing, optional notes/media, Siri integrations, and related functionality. Features may change as the product evolves.

2. Location and Reminder Reliability

PingBlu is designed as a convenience and productivity tool, not an emergency, safety-critical, medical, navigation, or life-safety service. Location services depend on device hardware, operating-system behavior, permissions, connectivity, battery state, environmental conditions, and third-party services. A reminder may be delayed, inaccurate, duplicated, or not delivered. Do not rely on PingBlu where failure or delay could cause injury, property damage, legal consequences, or other serious harm.

3. Accounts

You are responsible for maintaining the security of your account and device and for activity performed through your account. Provide accurate information and promptly notify us through our support channel if you believe your account has been compromised.

4. User Content and Sharing

You retain ownership of content you create or upload. You grant PingBlu a limited license to host, process, transmit, reproduce, and display that content solely as necessary to operate, secure, and improve the Services and provide features you request. You represent that you have the rights necessary to upload and share your content.

When you create a share link, recipients with access to the link may be able to view the location, reminder context, and media included in the share. You are responsible for deciding what to share and with whom.

5. Acceptable Use

You may not misuse PingBlu, interfere with the Services, attempt unauthorized access, use the Services to violate law or another person's rights, upload malicious content, abuse sharing features, or reverse engineer the Services except where applicable law expressly permits it.

6. PingBlu Pro and Auto-Renewable Subscriptions

PingBlu may offer auto-renewable PingBlu Pro subscriptions through Apple's App Store, including monthly and annual plans. The price and billing period shown on the purchase screen at the time of purchase control. Current launch pricing is $3.99 per month or $29.99 per year where offered, subject to App Store localization, taxes, and future changes.

Payment is charged to your Apple account upon confirmation of purchase. Subscriptions automatically renew unless canceled in accordance with Apple's subscription-management rules. Apple manages billing, cancellation, and applicable refunds. You can manage or cancel your subscription through your Apple account settings. Deleting your PingBlu account does not automatically cancel an Apple-managed subscription.

Features included in free and paid tiers may evolve, but we will provide purchased subscription access for the applicable paid period subject to these Terms and App Store requirements. Restore Purchases may be used where supported to restore an eligible entitlement associated with your Apple account.

7. Third-Party Services

PingBlu relies on third-party services, including Apple services, mapping/place providers, cloud infrastructure, analytics, and subscription infrastructure. Third-party services may have separate terms and privacy policies. PingBlu is not responsible for third-party services outside our control.

8. Privacy

Our Privacy Policy explains how PingBlu handles information. By using the Services, you acknowledge those practices.

9. Account Deletion and Termination

You may initiate deletion of your PingBlu account through the app's account settings. Account deletion removes the account and associated personal data within our control except information we are legally permitted or required to retain. Subscription billing managed by Apple must be canceled separately.

We may suspend or terminate access when reasonably necessary to protect users or the Services, comply with law, address fraud or abuse, or respond to a material violation of these Terms. Where appropriate, we may provide notice or an opportunity to resolve the issue.

10. Intellectual Property

PingBlu, its branding, software, interface, designs, and other service materials are owned by PingBlu or its licensors and are protected by applicable intellectual-property laws. These Terms grant you a personal, limited, non-exclusive, non-transferable, revocable right to use the Services for their intended purpose.

11. Disclaimers

To the maximum extent permitted by law, the Services are provided "as is" and "as available." We do not warrant uninterrupted or error-free operation, perfect location accuracy, or guaranteed reminder delivery. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

12. Limitation of Liability

To the maximum extent permitted by applicable law, PingBlu will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for losses resulting from missed or delayed reminders, loss of data, loss of profits, or inability to use the Services. Any limitations apply only to the extent permitted by law and do not limit rights that cannot legally be waived.

13. Changes

We may update these Terms as the Services evolve. The updated Terms will be posted at this URL with a revised effective date. Continued use after an update becomes effective constitutes acceptance where permitted by law; where additional consent is legally required, we will request it.

14. Apple-Specific Terms

If you download PingBlu from Apple's App Store, your use is also subject to Apple's applicable App Store terms and end-user license terms. Apple is not responsible for providing maintenance or support for PingBlu except as required by applicable law or Apple's own terms.
